The short version
- We collect what we need to run your orders, your account, our website and our marketing — and we tell you exactly what, in section 1.
- Never sold. Not for money, not to data brokers, not to anyone.
- Your data goes to three places: the tools that run our store, the carriers that deliver your order, and the platforms we advertise on. Nobody else, unless the law requires it.
- Our ads: we advertise on Meta, Google, TikTok, Pinterest, Reddit and Microsoft. Their pixels on our website see what you look at and buy here — that is how we measure our ads and show you ours. You switch it off with one click (section 5).
- The ATLETICA training app: your fitness profile and training data are used only to run the app — never for advertising, never sold. You can delete your app account at any time (section 7).
- Your rights: access, correct, delete, opt out of targeted advertising, appeal. Email service@atleticagear.com with the subject "Privacy request", call +1 (833) 958-8102 (toll-free), or use Your Privacy Choices in our footer.

This Privacy Policy explains how ATLETICA USA LLC (“ATLETICA”, “we”, “us”) collects, uses and discloses personal information when you visit atleticagear.com, buy from us online or in our Brand Store in Corona, California, use the ATLETICA training app as a US customer, contact our customer service, or otherwise interact with us (together, the “Services”). It also explains the choices and rights you have.
ATLETICA USA LLC, 1645 Leeson Lane, Corona, CA 92879, operates the Services. We are part of the ATLETICA Group; our products are engineered in Germany, and some of our support functions — and the training app — are provided by our affiliates in Europe (see “Affiliates and international processing”).
This policy is written for residents of the United States. If you live in California, please also read the section “Additional information for California residents”.
1. Personal information we collect
Depending on how you interact with us, we collect the following categories of personal information:
- Contact details: name, email address, phone number, billing and shipping address.
- Account information: login credentials, saved addresses, preferences, order history, rewards status.
- Order and payment information: the products you buy, order value, delivery details, payment method and transaction details. Card and bank details are collected and processed by our payment processors (see section 4); we don’t store full card numbers.
- Communications: what you tell us in emails, chat messages, phone calls, service tickets, product reviews, warranty claims, quote requests and surveys, including photos you send us of your equipment or your training space.
- Marketing preferences: whether you subscribed to our emails or text messages, and how you interact with them (opens, clicks).
- Device and usage information: IP address, approximate location derived from it, device and browser type, operating system, referring page, pages and products you view, items you put in your cart, and the dates and times of your visits — collected through cookies, pixels and similar technologies (see section 6).
- Training app data: if you use the ATLETICA training app — your fitness profile, the equipment you own, your training logs, and any notes, photos and videos you add (details in section 7).
- Inferences we draw from the above, for example which product categories you are likely interested in.
- Business contact details if you contact us on behalf of a gym, club, company or institution.
- Sensitive personal information: your account credentials; your payment card or bank account details, which are collected and processed by our payment processors on our behalf; and the body and fitness data you enter in the training app (section 7), which we treat as sensitive information and use only to provide the app. We don’t collect other categories of sensitive information (such as precise geolocation, government IDs or biometric data), and we don’t use or disclose sensitive information for purposes other than providing the Services and keeping them secure.
2. Where the information comes from
- From you, when you create an account, place an order, sign up for emails or texts, contact us, leave a review, use the training app, or visit our Brand Store.
- Automatically, from your device and browser when you use our website or the app, or open our emails.
- From our service providers, for example payment status from Shopify Payments, PayPal or Affirm, delivery status from our carriers, or support conversations from our helpdesk.
- From other companies, such as advertising and analytics partners, social media platforms you interact with us on, and — for business customers — public business directories.
3. How we use personal information
- To provide the Services: process and ship your orders, take payments, manage your account, arrange deliveries and returns, handle warranty claims, answer your questions, and run the Brand Store.
- To provide the training app: build and adapt your training program, track your progress and keep the app running (section 7).
- To communicate with you about your orders, deliveries, returns and account (you can’t opt out of these messages while you have an open order).
- For marketing: to send you emails, text messages or postal mail about products, offers and events if you have signed up or otherwise permitted this, and to show you ads for ATLETICA on other websites and apps. You can opt out at any time (section 9).
- To run our rewards program (section 10).
- To improve our products, website, app and service: analyzing how the website and the app are used, testing new features, and using your feedback and reviews.
- For security and fraud prevention: verifying orders, protecting accounts, detecting and preventing fraud, abuse or illegal activity.
- For legal reasons: complying with tax, accounting, product safety and other legal obligations; responding to lawful requests; establishing and defending legal claims.
We don’t use automated decision-making technology to make significant decisions about you (such as denying you goods or services). The training program the app suggests is a recommendation you can change at any time, not such a decision.
4. How we disclose personal information
Never sold. Not for money, not to data brokers, not to anyone.
Your data goes to three kinds of recipients: the tools that run our store and our app, the carriers that deliver your order, and the platforms we advertise on (section 5). Our own team in Germany works with it as part of ATLETICA. Nobody else, unless the law requires it or you ask us to. If ATLETICA is ever sold, the buyer inherits this promise.
Service providers that work for us. They may only use the information to perform their services for us. They include:
- Ecommerce platform: Shopify, which hosts our store, our checkout and our customer accounts, and the store apps that power search, wishlists and image delivery.
- Payment processing and financing: Shopify Payments, Shop Pay, PayPal, and Affirm (if you choose to pay over time). These companies act under their own privacy policies when they process your payment or financing application.
- Shipping and fulfillment: FedEx and FedEx Freight, XPO, TForce Freight, and our shipping software Descartes Pacejet. They receive your name, address, phone number and email to deliver your order and schedule freight appointments.
- Business systems: our ERP (Oracle NetSuite), email and office software, cloud hosting and IT security providers.
- Customer service: our helpdesk and chat platform (Gorgias) and our phone system.
- Marketing and communications: our email and SMS platform (Klaviyo), our reviews platforms (Loox and Okendo), our rewards platform (LoyaltyLion), and agencies that support our marketing.
- Analytics: Google Analytics and Shopify analytics.
- CRM for business customers: Zoho CRM.
- Training app: our cloud operations partner Perfsys, Amazon Web Services and MongoDB Atlas (hosting and database in Frankfurt, Germany), Dash0 (backend monitoring), Sentry (app crash reports), Google Firebase (notifications) and OpenAI (program matching) — see section 7.
Advertising platforms. Meta, Google, TikTok, Pinterest, Reddit and Microsoft — section 5 explains what they see and how you switch it off.
Affiliates. Companies in the ATLETICA Group, in particular ATLETICA Deutschland GmbH (Bodenheim, Germany), which provide product engineering, IT, order management and customer service support to ATLETICA USA and operate the training app (section 7). They are bound by this policy.
Reviews platform. If you post a review, it is published under the name you provide (we suggest first name and last initial) together with your review text and any photos or videos you add.
Legal and safety. Courts, regulators, law enforcement and other parties when required by law, to respond to lawful requests, to protect the rights, property or safety of ATLETICA, our customers or others, or to enforce our Terms of Service.
Business transfers. A buyer or successor in a merger, acquisition, financing or sale of all or part of our business, subject to this policy.
With your direction or consent, for example when you ask us to share information with a gym, an installer or a financing provider.
5. Our advertising
We advertise on Meta (Facebook and Instagram), Google (including YouTube), TikTok, Pinterest, Reddit and Microsoft (Bing). To measure those ads and to show you ATLETICA ads on their platforms, their pixels and conversion tracking run on our website. Here is exactly what that means.
What they see. What the pixel sees: the pages and products you look at, what you put in your cart, a purchase, and identifiers such as your IP address or a hashed version of your email address. Not your payment details, not your messages with us, not your training data.
What they do with it. They measure our campaigns and show you our ads. They may also use the data for their own purposes under their own privacy policies. That is why California and some other states call this “sharing” personal information — and may even call it a “sale”, although no money changes hands (section 17).
How you switch it off. One click on Your Privacy Choices (“Do Not Sell or Share My Personal Information”) in our footer. If your browser sends the Global Privacy Control signal, we switch it off automatically. Opting out changes nothing about your orders, your account or your rewards — you still see ATLETICA ads, just not based on your visit to our website.
Where this stops. None of this runs in the training app, and we never use your fitness data for advertising.
6. Cookies, pixels and similar technologies
We and our partners use cookies, pixels, tags and similar technologies to run the website (essential — for example your cart and login), remember your preferences, understand how the website is used (analytics), and measure and personalize advertising (marketing).
You can manage these technologies through your browser settings (every major browser lets you block or delete cookies), through the Your Privacy Choices link in the footer of our website, and through the opt-outs in section 9. Blocking essential cookies may prevent parts of the website from working.
We honor the Global Privacy Control (GPC) browser signal as a request to opt out of the sale or sharing of personal information for targeted advertising, for the browser and device sending the signal and — if you are logged in or we can otherwise link the signal to your account — for your account as well. We do not respond to other “Do Not Track” signals.
7. The ATLETICA training app
The ATLETICA training app for iPhone and Android is free for ATLETICA customers. It is developed and operated by our German affiliate ATLETICA Deutschland GmbH (section 4), which is responsible for the personal information processed in the app; ATLETICA USA is your point of contact for it in the United States. The app also has its own privacy notice, which you can read in the app and on its App Store and Google Play pages. This section explains what happens with your information when you use the app.
Signing in. You sign in with your email address and a one-time code we send to it — there is no password to remember. Because the app is free for customers, we check at your first sign-in whether the email address belongs to an ATLETICA customer. The answer is a simple yes or no: the app doesn’t receive your order history or store details, and it doesn’t store your store customer ID.
What the app collects.
- Account: your name and email address.
- Fitness profile: what you enter when you set up the app — your training experience, your goals (for example building muscle, losing weight, endurance or mobility), gender, age, height and weight (from which the app calculates your BMI), the ATLETICA equipment you own, and how often and how long you want to train.
- Training activity: the programs and workouts you follow, the weights, reps and sets you log, your progress, your favorites and your workout history.
- Optional content: notes, photos and videos you add to your workouts, and what you search for in the app.
- Technical data: device type and operating system, app version, language, IP address, and crash and performance reports.
How the app uses it. To build and adapt your training program, show you the workouts that fit your goals and your equipment, track your progress, keep the app running, secure and improving, fix crashes, and answer your support requests. To match a program to your profile, the app uses an AI language model provided by OpenAI as a service provider; it processes only the profile information needed for the match, on our behalf, and doesn’t use it to train its models. If you allow notifications on your device, the app can remind you to train; you can switch them off at any time in your device settings.
Your fitness data is sensitive. We treat your fitness profile and training activity as sensitive personal information (in some states, “consumer health data”) and use it only to provide the app’s features described here. We don’t use it for advertising, don’t sell it, don’t share it for targeted advertising, and don’t combine it with your shopping profile for marketing. The app contains no advertising and no third-party advertising trackers.
Who receives app data. The app is built by our own developers. A small number of service providers host and support it for us and process the data only on our instructions: Perfsys, the cloud operations partner that runs our infrastructure under a data processing agreement; Amazon Web Services and MongoDB Atlas, which host the app and its database in Frankfurt, Germany; Dash0 (backend monitoring); Sentry (crash reports); Google Firebase (notifications); and OpenAI (program matching, through our own OpenAI account). Your app data is stored in the European Union; Sentry and OpenAI process the data they receive in the United States. Apple and Google act independently for your App Store or Google Play account.
Deleting your account. You can delete your app account at any time in the app (Settings → Delete account) or by emailing service@atleticagear.com (subject line “Delete app account”). Deletion removes your profile, training history, notes, photos and videos within 30 days; technical logs are kept for up to 90 days and then deleted. Removing the app from your phone doesn’t delete your account — please delete it in the app first.
Your rights and choices in section 9 apply to app data as well. Send requests to service@atleticagear.com (subject line “Privacy request”); we forward requests that concern the app to the app operator. The app is intended for users 16 and older.
8. Marketing emails and text messages
Email. You can unsubscribe from marketing emails using the link in every email or by contacting us. We continue to send transactional emails about your orders and account.
Text messages. If you sign up for ATLETICA text alerts, you agree to receive recurring automated marketing and service text messages at the number you provide. Consent is not a condition of purchase; message frequency varies; message and data rates may apply. Reply STOP to any text to end all texts from us (order updates then come by email) and HELP for help. Our Text Message Terms apply.
9. Your choices and rights
Everyone can:
- Update account details and saved addresses in your account.
- Unsubscribe from marketing emails and texts (section 8).
- Manage cookies and opt out of targeted advertising through your browser settings, the Your Privacy Choices (“Do Not Sell or Share My Personal Information”) link in our footer, the Global Privacy Control signal, and the industry tools at optout.aboutads.info and optout.networkadvertising.org.
- Edit your fitness profile or delete your training app account in the app (section 7).
- Ask us questions or raise a complaint at service@atleticagear.com (subject line “Privacy”).
State privacy rights. If you live in California, Colorado, Connecticut, Delaware, Indiana, Iowa, Kentucky, Maryland, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Rhode Island, Tennessee, Texas, Utah or Virginia — or in another state with a comprehensive privacy law as it takes effect — you may have the right to:
- Know / access the personal information we have collected about you, including the categories, sources, purposes and recipients, and to receive a copy in a portable format.
- Correct inaccurate personal information.
- Delete personal information we collected from you, subject to legal exceptions (for example, we keep order records for tax purposes and warranty claims).
- Opt out of the sale or sharing of personal information and of its use for targeted advertising, as described above.
- Limit the use of sensitive personal information (we only use it to provide the Services).
- Not be discriminated against for exercising your rights. We don’t deny goods or services, charge different prices or provide a different level of service because you exercised a right — except for differences that are reasonably related to the value of your data in our rewards program (section 10).
- Appeal a decision on your request, where your state provides for it.
How to exercise your rights: email service@atleticagear.com (subject line “Privacy request”) or call our toll-free number +1 (833) 958-8102; for advertising opt-outs you can also use the Your Privacy Choices link in our footer. We need to verify that the request comes from you (or from an agent you authorized in writing); we use the information in your account and order history for this and may ask for more. We respond within 45 days, or tell you if we need longer as permitted by law. If we decline your request, you may appeal by replying to our decision email; we respond to appeals within 45 days and tell you how to contact your state attorney general if you are not satisfied.
Some of this information is also processed by Shopify for its own purposes (see section 13); Shopify’s rights portal is at privacy.shopify.com.
10. Rewards program — notice of financial incentive
Our rewards program gives you points, discounts and other benefits based on your purchases. Material terms: members with an annual order total of up to $7,499.99 are “Athletes” and earn points on every purchase (1x multiplier) plus a yearly birthday gift; members with $7,500 or more in orders within 12 months are “Pro Athletes” and additionally receive early access to promotions and new products. Athletes can redeem points for $35 discount codes (minimum order $200); Pro Athletes for $70 or $100 discount codes (minimum order $400 or $500). To run the program we collect and use your identifiers (name, email address), account information and commercial information (your order history and rewards activity). Because the benefits are linked to the collection of this information, California law treats the program as a financial incentive.
- How to join: create an account and opt in to the program on the rewards page or at checkout. Joining is voluntary.
- How to leave: email service@atleticagear.com at any time, or close your account; unredeemed points are forfeited when you leave.
- Value of your data: we estimate in good faith that the value of the personal information we collect through the program is roughly equal to the value of the rewards we provide to members. We calculate this on the basis of the expenses we incur in providing the rewards, one of the methods permitted by the California privacy regulations.
Full program rules are on our Rewards page. This notice is also linked where you join the program. We don’t sell the information collected through the program.
11. How long we keep information
We keep personal information as long as we need it for the purposes described here and as required by law: order, invoice and payment records for 7 years after the transaction (tax and accounting law); account information while your account is active and for 3 years after your last activity; warranty and service records for the warranty period plus 3 years; customer service communications for 3 years after the case is closed; marketing data until you unsubscribe, plus a short period to honor your choice; website analytics data for up to 26 months; security logs for up to 12 months; training app data while your app account exists and for up to 30 days after you delete it, app technical logs for up to 90 days. Where we no longer need information, we delete or de-identify it.
12. Security
We use reasonable security measures appropriate to the risk — including encryption in transit (TLS), access controls, and PCI-DSS-compliant payment processors — to protect personal information. No system is completely secure; please keep your password confidential and contact us immediately if you suspect unauthorized access to your account.
13. Relationship with Shopify
Our store is hosted by Shopify Inc., which collects and processes information about your visits and purchases to provide and improve the store for us. Shopify also uses certain information as its own controller — for example to power Shop Pay, fraud prevention and its Shop app — under the Shopify Consumer Privacy Policy. Depending on where you live, you can exercise rights over that processing at privacy.shopify.com.
14. Affiliates and international processing
We process personal information in the United States. Our affiliates and some service providers process it in Germany and other countries where they operate, subject to contractual protections. The training app is operated by our affiliate in Germany, and app data is processed in the European Union and the United States (section 7). Wherever we process it, this Privacy Policy applies.
15. Children
The Services are not directed to children under 13, and we don’t knowingly collect personal information from anyone under 13; the training app is intended for users 16 and older. If you believe a child has provided us with personal information, contact us and we will delete it. We don’t have actual knowledge that we sell or share the personal information of consumers under 16.
16. Third-party websites and social media
Our website links to other websites and embeds content from platforms such as YouTube and Instagram. Their privacy policies apply to the information they collect, including through embedded content and social plugins. If you contact us through a social media platform, that platform’s policy also applies.
17. Additional information for California residents
This section supplements the rest of this policy for California residents under the California Consumer Privacy Act (CCPA).

Sale and sharing. We don’t sell personal information for money or to data brokers. The CCPA defines “sale” and “sharing” broadly: letting the ad platforms named in section 5 use pixels and conversion tracking on our website counts as “sharing” identifiers, commercial information, internet activity, approximate geolocation and inferences for cross-context behavioral advertising — and may count as a “sale” — even though no money changes hands. That is the only case. You can opt out through the Your Privacy Choices (“Do Not Sell or Share My Personal Information”) link in our footer, by enabling the Global Privacy Control signal in your browser, or by contacting us. We don’t sell or share the information collected in the training app, and we don’t knowingly sell or share the personal information of consumers under 16.
Sensitive personal information. We use it only to provide the Services — including building your training program in the app — maintain security and prevent fraud, and as otherwise permitted by CCPA §1798.121; we don’t use it to infer characteristics about you beyond the training program you asked for.
Retention. See section 11 for the retention criteria and periods that apply to each category.
Notice at collection. This policy serves as our notice at collection. The financial incentive notice for our rewards program is in section 10.
Shine the Light (Cal. Civ. Code §1798.83). Other than the advertising described in section 5, which you can opt out of, we don’t disclose personal information to third parties for their own direct marketing purposes.
Authorized agents may submit requests on your behalf with your signed permission; we may also ask you to verify your identity directly with us.
18. Nevada residents
We don’t sell covered information as defined in Nevada law. You may still send us a request at service@atleticagear.com.
19. Changes to this policy
We may update this Privacy Policy from time to time. We post the new version here with a new “Last updated” date and, for material changes, notify you by email or with a notice on the website as required by law.
